These Terms of Use ("Terms") apply to your access to and use of the website located at https://www.tighterwallet.com, any mobile-optimized version of the site, and any related pages, content, and services (collectively, the "Services") operated by TighterWallet LLC ("TighterWallet", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Services.

Nature of the Services

TighterWallet is a consumer comparison and referral platform, not a lender, credit counselor, or debt relief provider. We connect consumers with third-party lenders, debt consolidation and debt relief providers, credit counselors, and other financial service providers in our partner network. We do not make credit decisions, we do not fund loans, we do not negotiate with creditors on your behalf, and we do not guarantee that you will be approved for, qualify for, or receive any specific product, rate, term, or offer. Rates, terms, fees, and availability vary by provider and depend on your individual circumstances, including your creditworthiness.

How the Services Work

When you submit information through the Services, we use that information to match you with one or more providers in our partner network whose products may be relevant to your needs. Your information may be shared with up to 15 providers per submission. Those providers may contact you by phone, SMS, email, or postal mail regarding their products and services, subject to the consent you provide at the time of submission and applicable law. Eligibility

You must be at least 18 years of age and a legal resident of the United States to access or use the Services. By accessing or using the Services, you represent and warrant that you meet these requirements and that you are not barred from receiving services under the laws of any jurisdiction applicable to you.

No Guarantee; No Offer of Credit

Nothing on the Services constitutes an offer, solicitation, or commitment to lend, settle debts, or provide any other financial service. TighterWallet does not guarantee that any specific provider will contact you, that you will qualify for any product, or that you will obtain any particular rate, term, or outcome. Debt consolidation loan APRs vary by lender and typically range from approximately 5.99% to 35.99% depending on creditworthiness, loan amount, and term. Debt settlement programs may negatively impact your credit score, may take several years to complete, and are not available in all states.

User Consent to Be Contacted

When you submit your information through a form on the Services, you may be asked to provide express written consent to be contacted by TighterWallet and by the matched providers at the telephone number and email address you provide, including by automated telephone dialing system, artificial or pre-recorded voice, and text/SMS messages, even if your number is on a state or federal Do Not Call list. Consent to be contacted in this manner is not required as a condition of receiving any product or service. You may opt out at any time via our Unsubscribe / Preference Center.

Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law, contract, intellectual property right, or other third-party right, or commit a tort;
  • Submit information about any person other than yourself without their express permission;
  • Submit false, inaccurate, or misleading information;
  • Interfere with, disrupt, or overload the Services or the networks or servers connected to the Services;
  • Use any automated means, including bots, scrapers, or crawlers, to access the Services or collect data from them;
  • Reverse engineer or attempt to discover the source code of any portion of the Services;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Use the Services in any manner that could expose TighterWallet, our partners, or any user to harm or liability.

Intellectual Property

The Services and all content on them, including text, graphics, logos, images, and software, are the property of TighterWallet LLC or its licensors and are protected by United States and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written permission.

Third-Party Links and Content

The Services contain links to third-party websites, including the websites of providers in our partner network. We do not control and are not responsible for the content, privacy policies, or practices of any third-party website. Your use of third-party websites is at your own risk and subject to the terms and policies of those websites.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TIGHTERWALLET DOES NOT REPRESENT OR WARRANT THAT THE SERVICES ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE, THAT ANY SPECIFIC PROVIDER WILL CONTACT YOU, OR THAT YOU WILL QUALIFY FOR ANY PRODUCT. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICES.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TIGHTERWALLET LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify, defend, and hold harmless TighterWallet LLC and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

Dispute Resolution; Binding Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Except for disputes in which either party seeks to bring an individual action in small claims court or seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property, you and TighterWallet waive your rights to a jury trial and to have any dispute arising out of or relating to these Terms or the Services resolved in court. Instead, all disputes arising out of or relating to these Terms or the Services will be resolved through confidential binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

Class Action Waiver. You and TighterWallet agree that any dispute will be resolved solely through individual arbitration and will not be brought as a class arbitration, class action, or any other type of representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.

These Terms affect interstate commerce, and the enforceability of this section is governed by the Federal Arbitration Act, 9 U.S.C. ยง 1 et seq. Any claim arising out of or related to these Terms or the Services must be filed within one year after such claim arose; otherwise, the claim is permanently barred.

Opt-Out. You have the right to opt out of binding arbitration within thirty (30) days of the date you first accepted these Terms by emailing us at support@tighterwallet.com. To be effective, the opt-out notice must include your full name and clearly indicate your intent to opt out of binding arbitration.

Governing Law and Venue

These Terms and your access to and use of the Services will be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law rules. Any dispute between the parties that is not subject to arbitration or cannot be heard in small claims court will be resolved in the state or federal courts located in Delaware.

Termination

We reserve the right, without notice and in our sole discretion, to terminate or suspend your right to access or use the Services at any time for any reason. We are not responsible for any loss or harm related to your inability to access or use the Services.

Changes to These Terms

We may make changes to these Terms from time to time. If we make changes, we will update the "Last updated" date above and, where required, provide additional notice through the Services. Your continued use of the Services after any change becomes effective constitutes your acceptance of the revised Terms.

Severability

If any provision or part of a provision of these Terms is found to be unlawful, void, or unenforceable, that provision or part of the provision will be deemed severable from these Terms and will not affect the validity or enforceability of any remaining provisions.
